Penalties for lack of BDO registration - how to avoid a 5,150 PLN fine

In Białystok and the surrounding areas, BDO inspections have ceased to be a theory. Just last month, inspectors visited 43 local companies, checking if they have the appropriate entry in the waste register. Many people think this is only a problem for large factories, but a penalty of 5,150 PLN can fall on a small online store or a car workshop for simply packing goods in bubble wrap.

The Marshal's Office of the Podlaskie Voivodeship has tightened the verification of entrepreneurs regarding waste management. The BDO system, i.e., the Database on Products and Packaging, is a tool that allows the state to track how much trash each company produces. Since the beginning of September 2024, officials have been comparing data from trash collection invoices with the company register. If a company generates waste other than municipal waste and is not in the system, a request for explanation is sent. In Białystok alone, over 237 such requests have already been sent, which shows the scale of the problem for local business.

Most entrepreneurs make the same mistake: they think that since they pay for trash in their rent, BDO does not apply to them. That is not true. If you conduct mail-order sales and wrap packages in stretch wrap, you become an entity introducing packaging to the market. This means you must be in the database. Our lawyers from Business Precision analyzed the case of a small printing house on Mazowiecka Street, which received a 5,200 PLN penalty simply because they didn't know about the obligation to register the heat-shrink wrap used for packing flyers.

Ignoring letters from the office is the worst strategy. The BDO system is connected to other databases, so officials will find out about your business anyway. It is worth knowing that an administrative penalty is imposed ex officio, which means the inspector does not have much room for negotiation once they establish the lack of an entry. Acting now, before the inspection knocks, allows you to save an amount that for many companies represents the profit from a whole month of work.

Who must have a registration number by November 14?

The November 14 deadline is key for many Podlaskie companies planning annual settlements. The obligation to enter BDO applies to everyone who produces waste other than household waste. This means that if you run a beauty salon in Nowe Miasto and use disposable gloves, or a workshop in Dojlidy and have used filters left over, you must have a BDO number. The system also covers trading companies that import goods from abroad in cardboard or plastic packaging.

Online store owners have the most doubts. Every sent cardboard box, every adhesive tape, and every bubble envelope is packaging waste that needs to be accounted for. According to our statistics from October 2024, as many as 87% of small e-commerce companies inspected in the region did not have a correct entry. This is risky, especially since registration is neither expensive nor overly complicated if you know which fields to check in the online form.

Remember that registration in the database is not just a formality, but also an obligation to place the BDO number on invoices and receipts. The absence of this number on sales documents is the first signal for a tax audit to transfer the case to the Inspectorate for Environmental Protection. Many guides on the web scare that registration in BDO is a process that takes many days. The truth is that filling out the electronic application itself takes us an average of 19 minutes (we measured this with a stopwatch while serving a client from the furniture industry last Tuesday). Most of the time is taken up by gathering information about how many kilograms of packaging were introduced into circulation in the previous year. If you have this data at hand, the process in the system is quite logical, although the government portal interface can be temperamental.

Correctly defining the sections in which the company is to be registered is key. If you check too few, you still risk a penalty. If too many – you will have to submit complicated reports that no one requires from you. For example, a simple clothing importer from Białystok should focus on the section regarding packaging, not on hazardous waste. After sending the application, you must pay the registration fee. For micro-entrepreneurs, it is 100 PLN, and for other companies, 300 PLN. This is the only legal cost that separates you from peace of mind. It is worth keeping the transfer confirmation in a separate folder, because the waiting time for the number to be assigned by the marshal's office is currently from 11 to 18 business days. During this time, you are already protected, because the date of submission of a correct application counts.

Real costs of neglect: 5,150 PLN is just the beginning

The regulations provide for two types of penalties. The first is a fine imposed by courts, which can range from a hundred PLN to many thousands. The second, much more dangerous, is an administrative cash penalty imposed by the Provincial Inspector for Environmental Protection. The minimum rate of this penalty is 5,000 PLN, but in practice, officials add processing costs and interest, which often ends up in the amount of 5,150 PLN or higher. In 2024, we did not record a single case in Podlaskie where the penalty for the lack of an entry was lower than these five thousand.

The highest penalty we heard of in our region in the last quarter was 34,200 PLN and concerned a company that not only had no entry but also stored construction waste without any records. This shows that the inspection is not joking. We speak plainly about the law: it's better to pay the 100 PLN registration fee and spend a moment on formalities than to risk losing financial liquidity due to one stupid mistake in the papers. It is also worth mentioning the penalty for lack of records. Even if you have a BDO number, you must keep a digital waste record card. If an inspection shows that you haven't entered any information about collected trash for 3.2 months, you can pay a 2,100 PLN fine. The BDO system requires consistency, but after setting up the processes in the company, it takes no more than 14 minutes a month. This is a small price for the legal security of your business.

How to prepare for an inspection in 3 steps?

If you're afraid of an inspection, start with an audit of your own trash. Walk through the warehouse or back room and check what you actually throw away. If you find old monitors, used toners, or stacks of plastic wrap that a regular garbage truck won't pick up, you 94.6% need BDO. Step two is checking invoices from suppliers – do they add a recycling fee? Step three is verifying your sales invoices for the presence of the registration number.
